Terms and ConditionsDEFINITIONS The Buyer, You, Your, He or She refers to the person who purchases or agrees to purchase goods from the Seller. I, the Seller or me refers to the person trading as Pure PC Services. GENERAL These Terms and Conditions are provided for Your information, in line with legislation contained in the Consumer Protection (Distance Selling) Regulations. This legislation does not apply where goods are bought by auction or for business use. These Terms and Conditions do not affect Your statutory rights as a consumer. All contracts of sale made by the Seller, where the Buyer is a consumer, are subject to these Terms and Conditions. PRODUCT SPECIFICATIONS It is the responsibility of the Buyer to check the compatibility and suitability of goods for any particular purpose before making any purchase. The Seller does not provide technical support. All items have been inspected. Used items have been tested for functionality, but may have superficial physical defects including, but not limited to, scratches, dings or dents. The entire risk as to the quality and performance of used items is with the Buyer. OEM product packages do not contain the printed documentation or any bundled application software, driver software or hardware components which form part of the full retail package. No guarantee or warranty is given or implied unless clearly stated in the listing. PAYMENT For all purchase's immediate payment is required. The contract will be deemed as active once the Seller has received payment. I accept PayPal only. All payments must be in British Pound Sterling. Full payment must have been received before goods are despatched. Non-payers will be contacted and have 5 working days to provide payment. DELIVERY All items are sent by either Royal Mail or Parcelforce. Normally goods are despatched within one business day after I have received full and cleared payment. Whilst every effort will be made to despatch goods within this timeframe, time of delivery shall not be of the essence and I shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or anybody else. The risk in the goods shall pass from the Seller to the Buyer on delivery of such goods to the Buyer. I despatch only to the address shown on Your PayPal account. I do not despatch to PO Box addresses and to addresses outside the European Union. The delivery charge includes postage, packaging and handling and is non-negotiable. I may obtain proof of posting. The Buyer is advised to inspect the goods on receipt and let the Seller know in writing within 48 hours of receipt if the goods are damaged. If the Buyer does not do this within the specified timeframe He is deemed to have accepted the goods. If goods are returned to Me after unsuccessful attempted delivery You can either receive a refund (less postage paid) or have the goods redelivered at Your expense. You must pay for the cost of redelivery before the goods are posted again. If You have not received the goods You must inform Me about non-delivery within 10 working days within the UK, and 15 working days outside the UK. If the goods have still not arrived after 15 working days within the UK, and 20 working days outside the UK, the Seller will refund the Buyer in full. FORCE MAJEURE The Seller shall not be liable for any breach of contract, delay or failure to perform if the delay or failure is due to, but not limited to, Acts of God, riots, strikes, legislation or other cause beyond the Seller’s reasonable control. If the Seller chooses not to enforce a right under this contract, that decision will not prevent the enforcement of other rights, or the same right on a later occasion. LIABILITY Under no circumstance shall the Seller be responsible for any indirect, incidental or consequential damage. RETURNS POLICY Under the Distance Selling regulations the Buyer can return the goods within seven working days after the day of delivery for a refund of the original amount paid, including the delivery charge. The cost of returning and appropriately insuring the goods until satisfactory receipt by the Seller will be borne by the Buyer. Returned goods must be complete and in their original condition, not worn or altered and must be in their original packaging, no tags removed, and with all original accessories and documents. You must take reasonable care of the goods. You are responsible for returning the goods, and are advised to insure them and obtain proof of posting. If You wish to exercise Your statutory right as a consumer to cancel Your contract with Me, You must first notify Me in writing within the statutory period. I will then contact You with a Product Returns Number. You will then be required to return the goods to the Seller without delay before a refund can be processed. The Seller’s postal address is 2 Spencer Close, Walderslade, Chatham, Kent, ME5 7RE. A full refund, including the return postage costs, is payable if there was a mistake in the listing, the goods were damaged in transit or are found to be faulty. You must contact Me in writing to obtain a Product Returns Number before returning the goods. For a refund to be processed I must receive the goods within two weeks from the day of delivery. The Product Returns Number provided must be quoted on all returned goods so that the goods can be properly identified. The Seller cannot be held responsible for goods returned without proper identification. Any refund due will be made to the Buyer’s PayPal account. MISCELLANEOUS If any part of these Terms and Conditions is found to be unenforceable this shall not affect the validity or enforceability of the remainder of these Terms and Conditions. These Terms and Conditions shall be construed in accordance with English law. |
